BioSynCare exists to help people improve their well-being through scientifically informed sound and music. These Terms govern your use of the BioSynCare application on all platforms (web, iOS, and Android). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

BioSynCare provides audiovisual and respiratory guidance techniques aimed at supporting relaxation, focus, and general well-being. The App does not provide medical advice and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The content and sessions offered — including those generated by our AI assistant (Seraphony) — are for wellness purposes only and should not be considered a substitute for professional medical guidance. Always consult a qualified healthcare professional before making decisions related to your health.

You must be at least 16 years old to use the App. Because BioSynCare involves sound stimulation and breathing guidance techniques, we believe this is the responsible minimum age for independent use. If you are under the age of majority in your country, you must have parental or guardian consent.

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. If you believe your account has been compromised, contact us immediately.

Some features are available through paid subscription plans (Plus and Premium). Payment processing depends on your platform: • iOS: payments are processed through Apple's in-app purchase system. Renewals, cancellations, and refunds are handled by Apple under the App Store terms. • Android: payments are processed through Google Play. Renewals, cancellations, and refunds are handled by Google under the Google Play terms. • Web: payments are processed by Stripe. You can manage your subscription and billing through the Stripe customer portal accessible from your account settings. Subscription fees are charged at the beginning of each billing period. You may cancel at any time; access continues until the end of the current billing period.

BioSynCare includes Seraphony, an AI assistant that generates personalized audio session presets based on your input and preferences. AI-generated sessions are created for general wellness purposes. They are not medical prescriptions and may not be suitable for every individual. You use AI-generated content at your own discretion.

The App includes collaborative rooms where users can join shared sessions and exchange chat messages. You are solely responsible for the content you post. You agree not to post content that is abusive, hateful, illegal, or that violates the rights of others. We reserve the right to remove any user content and to suspend or terminate accounts that violate these guidelines, at our sole discretion.

You agree not to: • Copy, modify, or distribute the App or its content • Use the App for unlawful purposes • Attempt to reverse engineer, decompile, or tamper with the App infrastructure • Interfere with other users' enjoyment of the Service • Use automated tools to access the Service without our consent

All software, audiovisual content, audio synthesis protocols, text, graphics, and trademarks are the exclusive property of BioSynCare or its licensors. You receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. This license does not grant you ownership of any content or intellectual property.

BioSynCare primarily uses rhythmic auditory stimulation techniques, including binaural beats, isochronic tones, and other forms of brainwave entrainment, together with breathing guidance. Some experiences may also include gentle visual guidance elements, such as breathing cue animations. These visual elements are designed as smooth breathing-style transitions rather than rapid flashing or strobe-like effects. Even so, rhythmic sensory stimulation may not be appropriate for everyone. If you have epilepsy, a history of seizures, photosensitive epilepsy, unexplained blackouts, or any neurological condition that may be affected by rhythmic auditory or visual stimulation, do not use the App without first consulting your physician. Additional precautions: • Do not use the App while driving, operating machinery, or in any situation requiring your full attention. • If you have tinnitus, hearing disorders, or use hearing aids, exercise caution and consult your audiologist. • If you have a cardiac pacemaker or other implanted medical device, consult your physician before use. • If you are pregnant, consult your healthcare provider before using breathing exercises or entrainment features. • If you experience dizziness, discomfort, or any adverse reaction, stop using the App immediately. BioSynCare is committed to responsible design informed by the scientific literature. We favor rhythmic audio and gentle breathing-style visuals rather than photic or strobe-like effects as a deliberate safety choice. Nevertheless, individual responses to sensory stimulation vary, and these precautions cannot eliminate all risk.

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted availability. This disclaimer does not affect your statutory rights as a consumer under EU law, which cannot be waived or limited by contract.

To the maximum extent permitted by applicable law, BioSynCare and its contributors shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of or inability to use the App. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

We may suspend or terminate your access if you violate these Terms or misuse the Service. You may stop using the App and delete your account at any time through the account settings or by contacting us. Upon termination, your right to use the App ceases, but provisions that by their nature should survive (including sections on liability, IP, and governing law) will remain in effect.

Your use of the App is also governed by our Privacy Policy, which describes what data we collect, how we use it, and what rights you have. The Privacy Policy is available within the App and on our website.

BioSynCare shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, infrastructure failures, cyberattacks, or actions of governmental authorities.

We may update these Terms to reflect changes in the Service or in applicable law. When we do, we will update the "Last updated" date at the top. For material changes, we will notify you via email or a prominent in-app notice. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of Italy. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Varese, Italy. If you are a consumer residing in the EU, you retain the benefit of any mandatory consumer protection provisions of the law of your country of residence. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and BioSynCare regarding your use of the App and supersede any prior agreements or understandings.
